US Judge Orders Freedom of Kilmar Abrego Garcia from ICE Custody

A court has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement lacks legal authority.

"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge wrote in her ruling.

The case originates in a mistaken deportation to El Salvador earlier this year, which US authorities later admitted was an mistake. Following his repatriation to the United States to answer alien smuggling charges, he was held in federal custody.

In her order, the court pointed out that the government lacks a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."
